 Auction Terms & Conditions of Sale

These Terms & Conditions apply to all online and onsite auctions conducted by No Longer Needed Pty.Ltd. (hereafter “the Auctioneer”, “we”, or “us”). By registering or bidding, you confirm you have read, understood, and agreed to be bound by these terms.


1. Bidder Registration

  • Bidders must be 18 years or older.
  • All bidders must register using accurate details including full name, address, phone number, email, and valid credit card.
  • Registration confirms acceptance of these terms and may include a fee.
  • Suspended or banned users may not re-register.

2. Auction Platform and Software

  • We use the Webtron online auction platform.
  • Technical issues may occur; we do not guarantee uninterrupted access or bidding.
  •  This agreement shall be governed by & construed in accordance with the laws of Victoria, Australia. In the event of any inconsistency or conflict between the terms of this agreement & any other applicable provision or jurisdiction, the laws of Victoria, Australia shall prevail.

3. Bidding Rules

  • Bidding is binding and indicates intent to purchase.
  • Bidding is acknowledgement that the bidder has had the opportunity to inspect the goods
  • Bids cannot be withdrawn or amended once placed, including Auto bids.
  • In the event of identical bids, the earlier one takes precedence.
  • Vendors reserve the right to bid personally or through agents.
  • The Auctioneer may accept, reject, or prioritize bids.

Bidding Conduct & Seller Guarantee

3.2 Fair Bidding Policy
No Longer Needed Pty.Ltd. is committed to maintaining the integrity of all auctions conducted through this website. We guarantee the following:

  • We will never place bids on our own auction items, nor will we engage in any practice that artificially increases the bid price.
  • If you are outbid during an auction, you can be assured the bid was placed by another genuine participant—not by No Longer Needed or any associated party.
  • Where an item is subject to a reserve price, this will be clearly disclosed in the item listing prior to the commencement of bidding.

We do not engage in shill bidding, bid manipulation, or any conduct intended to mislead or disadvantage bidders.


4. Deposits

  • No Deposits required on a single item bidding lower than $19999
  • For online auctions:
    • A 25% deposit is charged when bids per item is equal to or greater than s $20,001.
    • A 15% additional deposit applies to items equal to or greater than $40,000.
  • Deposits will be charged to the registered credit card and refunded if you are not the successful bidder.

5. Auction Timings & Closures

  • Auctions have fixed start and end times.
  • A bid placed within the final “60 seconds extends bidding by a set time (e.g., 1 minutes).
  • Items may close in batches (e.g., lots 1–5, then 6–10, etc.).
  • It is the bidder’s responsibility to monitor auction outcomes.

6. Purchase Obligations

  • All sales are final and legally binding.
  • Bidders act as principals unless written notice of agency is provided.
  • Prices are subject to:
    • 10% GST (unless otherwise stated).
    • A buyer’s premium, also subject to GST.
  • Items are sold “as is, where is” with no warranties or guarantees.

7. Payment Terms

  • Full payment must be made:
    • On the auction day (onsite), or
    • By 4 PM on the next business day (online).
  • Acceptable payment methods:
    • Cash or EFTPOS (onsite).
    • Visa, Mastercard, or bank transfer (online).
    • Amex and Diners are not accepted.
  • Invoices will be issued post-sale, and cards may be charged automatically.

8. Collection & Removal

  • Items must be collected within the timeframe listed online or in the catalogue.
  • A paid invoice with cleared funds is required for collection.
  • Buyers are responsible for collection, transport, and any damage caused during removal.
  • We do not provide staff or lifting equipment; buyers must arrange their own.
  • All disconnections must be carried out by licensed professionals.
  • No claims will be accepted after removal.

9. Risk

  • Risk passes to the purchaser immediately upon the fall of the hammer.
  • We are not liable for lost or missing items post-sale.

10. Descriptions & Inspections

  • All goods are described as accurately as possible, but no responsibility is accepted for errors, shortages, or discrepancies.
  • Descriptions and images are for identification only.
  • Buyers must inspect items and rely on their own judgment.
  • No warranties or guarantees apply post-sale.

11. Site Safety & Access

  • Auction and collection sites may be hazardous. Entry is at your own risk.
  • We do not provide safety advice. No Longer Needed Pty.Ltd. acts solely as a sales agent and not as a safety officer.
  • Appropriate PPE may be required.

12. Occupational Health & Safety (OH&S)

  • Buyers must ensure equipment is OH&S compliant before use.
  • Breaches of safety regulations are the buyer’s responsibility and may incur legal penalties.


14. Auctioneer Rights

The Auctioneer reserves the right to:

  • Cancel, extend, or reopen auctions.
  • Set reserves or starting bids.
  • Combine or split lots.
  • Correct pricing errors.
  • Refuse bids or access.
  • Resell defaulted lots with recovery of shortfalls and costs from the buyer.

15. Consumer Law Waiver

Under the Competition and Consumer Act 2010 (Cth), certain consumer guarantees do not apply to goods purchased at auction. These include:

• The guarantee as to acceptable quality (section 54)
• The guarantee as to fitness for purpose (section 55)
• The guarantee that goods will match their description or sample (sections 56 & 57)
• The guarantee that repairs or spare parts will be reasonably available (section 58)
• The guarantee that express warranties will be honoured (section 59)

This exclusion applies in the context of goods sold by auction where the buyer has the opportunity to inspect the goods prior to purchase.

16. Breach of Terms

Failure to comply may result in:

  • Forfeiture of deposits or payments made,
  • Resale of items at the buyer’s risk and cost,
  • Bans from future participation.
